Mushrooms Canada PADERNO Cookwear Set Contest Rules
Co-Sponsored by: Mushrooms Canada and Visa Canada (“the Sponsors”)
1. Consent to Use Personal Information:
Mushrooms Canada PADERNO Cookwear Set Contest (the "Contest") electronically and voluntarily providing your personal information (including, but not limited to e-mail address, first name, last name, date of birth, phone number, mailing address, and daytime phone number) (collectively "Registrant Information") you consent to Mushrooms Canada’s collection and use of the Registrant Information to administer this Contest. In addition, by opting-in online, you consent to Mushrooms Canada's use of your Registrant Information to contact you to promote draws, interactive features, newsletters, recipes, updates, contests and other marketing initiatives. Your consent to the Additional Uses may be revoked at any time by submitting your e-mail address on the "subscribe" page at http://www.mushrooms.ca/email-list.aspx and clicking unsubscribe.
2. Contest Period:
NO PURCHASE NECESSARY. The Contest shall run from September 23rd, 2013 to November 29th, 2013 (the "Contest Period"). All entries must be received no later than 11:59 p.m. (EST) on November 29th, 2013, after which time the Contest will be closed and no further entries shall be accepted.
3. Contest Participation:
By entering this Contest, you agree to be bound by these Contest Rules. In order to enter the Contest, and qualify for a chance to win the Grand Prize you may enter by logging on to the website www.mushroomsgopink.ca, clicking the Contest Icon, and completing and submitting the entry form in its entirety.
Only one (1) qualifying entry per e-mail address/person will be accepted during the Contest Period.
4. Grand Prizes:
One (1) Grand Prize is available to be won, which consists of a PADERNO Cookwear Set, valued at $780.
5. Eligibility:
This Contest is open to all residents of Canada, who are the age of majority or older (at the time of entry). The employees of Sponsors and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies and members of their respective immediate families are not eligible to enter this Contest.

7. General Rules:
a) Mushrooms Canada shall not be responsible for or bear any liability for: (i) late-received, lost, unintelligible/illegible, incomplete, or misdirected entries; (ii) entries which fail to comply with these Contest rules; and (iii) any failure of the Mushrooms Canada websites during the Contest Period, including any problems or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material in the Contest, all of which may affect an entrant's ability to participate in the Contest.
b) Sponsors reserve the right to cancel or suspend any portion of this Contest should a virus, bug or other cause beyond the reasonable control of Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
c) By participating in this Contest, the Grand Prize winner agrees that his/her name, residence, photograph, voice and/or image may be used in any and all forms of media, without any further compensation by Sponsors and waives all rights (including moral rights) with respect to printed, broadcast and other forms of publicity. Written confirmation of the foregoing in the form of the Consent referred to above must be executed by the Grand Prize winners and provided to Mushrooms Canada prior to such winner being declared eligible to receive the Grand Prizes.
d) All entries are subject to verification by any of the Sponsors and Sponsors reserve the right to cancel and revoke any entries if they are found to be improper or if the entrant is subsequently found not to be eligible pursuant to these Contest rules.
e) In the event of unavailability of the stated Grand Prizes (or any portion thereof), Sponsors, in their sole discretion, reserve the right to substitute a prize of equal or greater value.
f) The Grand Prizes are not transferable, not refundable, not redeemable for cash, will not be extended under any circumstances and must be accepted as offered.
g) By participating in this Contest, entrants agree to be bound by these Contest rules and the decisions of Mushrooms Canada in awarding the prizes, which decisions shall be final and binding upon all entrants. Failure to comply with these rules may void an entrant's rights vis-a-vis the awarding of the Grand Prize. Interpretation of these Contest rules by Sponsors shall be final.
h) Shipped prizes shall not be insured and Sponsors shall not assume any liability for lost, damaged, or misdirected prizes.
i) The Sponsors may terminate this Contest at anytime and may amend the rules or administration of this Contest without notice in their sole discretion in any commercially reasonable manner.
j) In the event of a dispute as to who submitted an electronic entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected entrants may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.
k) The Contest Sponsor is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant provides the Sponsor with explicit permission to do so as indicated on the entry form where it asks the user if they would like to receive additional communication from the Sponsor(s).
l) The Contest shall be governed in accordance with all provincial laws and the federal laws of Canada.
m) Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
8. Random Draw and Odds:
The random draw for the Grand Prize, from the eligible entries received, will be held in Guelph, Ontario on or about December 2, 2013. The random draw will be carried out by RKD Web Studios.
Within 72 hours from the time of the draw, the selected entrant for the Grand Prize may be notified either by: (i) an initial telephone call during regular business hours (EST) at the home telephone number; or (ii) an e-mail at the e-mail address provided at the time of entry. If the selected entrant cannot be reached within five (5) business days from the time of initial contact, an alternative entry may be selected until such time as a selected entrant satisfies the terms of this section.
Once contacted, a selected entrant must, in order to be declared eligible to receive the Grand Prize:
(i) comply with all Contest rules;
(ii) sign Mushroom Canada's standard declaration of compliance with the Contest rules, release and consent to publicity form (the "Consent"), which shall serve as the selected entrant's agreement to release and cover Sponsors and their respective parent(s), subsidiaries, affiliates and/or related companies and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising, media buying and promotional agencies from any liability in connection with the Contest and/or the prizes. If Mushrooms Canada does not receive a signed Consent back from the selected entrant within seven (7) days from the delivery of the Consent to the entrant, then such entrant shall forego any right or entitlement to the Grand Prize and Mushrooms Canada may draw another entrant's name.
The odds of being selected in the random draw depend on the number of eligible entries received. A qualifying entry and/or entrant may only win once.
